Terms of Use

These Terms of Use govern your use of dynamicdfma.com and its pages (the “Website”), operated by Dynamic DFMA Inc. (“Dynamic DFMA”, “we”, “us”). By using the Website you agree to these terms. If you do not agree, please do not use it. Services we provide to clients, and software such as COILQ, are governed by their own agreements.
1. Information only
The Website describes our company, our services, past projects and our research. It is general information, not engineering, architectural, legal or other professional advice, and it does not create a client relationship. Research visuals, animations, figures and examples on the Website are illustrative concepts. Do not rely on them for design, fabrication, installation or any other decision about a real project; project advice is given only under a written agreement and by the appropriately qualified professionals.
2. Intellectual property
The Website and all of its content, including its text, graphics, images, animations, 3D scenes, design, layout, look and feel, source code and the selection and arrangement of its materials (the “Materials”), are owned by or licensed to Dynamic DFMA Inc. and are protected by the copyright, trademark and other intellectual property laws of Canada and other jurisdictions. Third-party images are shown with credit and remain the property of their owners. The Dynamic DFMA name and logo, and the slogan “Building the future. Piece by piece.”, may not be used without our written permission.
You may view the Website and print or save single pages for your own internal, non-commercial reference, provided you keep all notices. Except as allowed here or with our prior written consent, you may not copy, reproduce, republish, modify, adapt, translate, frame, scrape, reverse engineer or create derivative works from the Materials, in whole or in part, or use them to design, develop or market a competing product, service or website.
3. Text and data mining, and AI
Dynamic DFMA expressly reserves all rights in the Materials with respect to text and data mining, including for the purposes of Article 4 of EU Directive 2019/790. No person may use any crawler, scraper, bot or other automated means, or any artificial intelligence or machine-learning system, to collect, extract or reproduce the Materials, or to train, fine-tune, ground or evaluate any such system, without our prior written consent. Standard search-engine indexing that respects our robots.txt is permitted.
4. Acceptable use
You agree not to: use the Website in breach of any law; try to gain unauthorised access to it, our client portal or our systems; interfere with its security or operation, including by introducing malicious code or by overloading it; impersonate anyone; or send unsolicited marketing through our contact form.
5. Client portal
Access to our client portal is by invitation. You are responsible for keeping your sign-in secure and for activity under your access. Files and drawings shared through the portal are confidential to the project they relate to, and are governed by the agreement for that project.
6. Links to other sites
The Website links to sites we do not control, such as Instagram and LinkedIn. We are not responsible for their content or their privacy practices. COILQ is operated by Dynamic DFMA Inc. under its own terms and privacy policy.
7. Disclaimer
The Website is provided “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, about its accuracy, completeness, availability or fitness for a particular purpose, and we may change or remove content at any time without notice.
8. Limitation of liability
To the extent permitted by law, Dynamic DFMA and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business, arising from your use of, or inability to use, the Website or reliance on its content. Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer that cannot be waived.
9. Indemnity
You agree to indemnify Dynamic DFMA against claims, losses and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of the Website.
10. Privacy
Our Privacy Policy explains how we handle personal information, including cookies and your privacy choices.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts of the Province of Ontario have exclusive jurisdiction, except where the law of your place of residence gives you the right to bring a claim in your local courts.
12. Changes and general terms
We may update these terms; the effective date above shows the latest version, and continued use of the Website means you accept it. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.
